Rule 15
Registration of Government Land or Public Land
:
(1) According to sub-section (4) of section 8 of the Act, government land should be registered as follows:-
(a) the land being enjoyed by the government office with or without proof of ownership in the name of the concerned office on the basis of such proof or enjoyment,
(b) Government forest area land in the name of Government of Nepal,
(c) Except as mentioned in clauses (a) and (b), other government land in the name of the Government of Nepal.
(2) According to sub-rule (1), the government office or village development committee or municipality shall provide necessary assistance by sending its representative in the registration of government land.
(3) When registering public land in accordance with Section 4 of the Act, the nature and details of the land shall be clearly mentioned in the regional register, and it shall be stated as public land in the palace of the owner of the land.
(4) After registering the land according to sub-rules (1) and (3), the surveyor Goshwara should prepare the land owner registration certificate and submit it to the office in case of land occupied by the government office and in the case of other government or public land to the relevant district administration office.
(5) Even if any land that has been previously measured by government or public land has been used as an awad, commode or homestead, such land shall be registered as government or public land according to the previous survey.
(6) Apart from the areas which have been measured on the basis of control points, a survey of government or public land shall be prepared and kept on the basis of topographical measurement maps in other areas.
